1. This application under Section 5 of the Limitation Act is filed seeking condonation of delay of 100 days in filing the appeal against the judgment of acquittal.

2. Heard learned counsel for the petitioner, learned APP, Ms.Krina Calla for the first respondent-State and Mr.Mahek B. Raval, learned counsel for respondent nos.2 to 5.

3. Learned counsel for the petitioner submits that the petitioner is aged about 60 years and he has been suffering from the ailment of paralysis and he has been undergoing the treatment and, due to the said ailment, he could not prefer the appeal in time, and as such there is a delay of 100 days in Page 1 of 2 Uploaded by R.S. The said explanation offered by the petitioner is not seriously controverted by the respondents and the petition is not seriously opposed by the respondents. Therefore, we are of the considered view that the petitioner is entitled for condonation of delay of 100 days in filing the appeal.

4. Resultantly, the application is allowed condoning the delay of 100 days in filing the appeal.
