1. This application under Section 5 of the Limitation Act is filed seeking condonation of delay of 39 days in filing the appeal against the judgment of acquittal.
2. Heard learned counsel for the petitioner, Mr.Bhishma A. Raval, learned APP, Ms.Krina Calla for the first respondent- State. Despite service of notice on respondent no.2, none appears. Thus, this application is not opposed by respondent no.2.
3. It is stated that the petitioner has no means to engage an advocate to prefer an appeal and he has approached the High Court Legal Services Committee seeking appointment of legal Page 1 of 2 Uploaded by R.S. Thus, the petitioner has satisfactorily explained the delay.
4. Therefore, the petition is allowed condoning the delay of 39 days in filing the appeal.
