1. This application under Section 5 of the Limitation Act is filed seeking condonation of delay of 44 days in filing the appeal against the judgment of acquittal.

2. Heard learned counsel for the petitioner, learned APP, Ms.Krina Calla for the first respondent-State. Despite service of notice on respondent no.2, none appears. Thus, this application is not opposed by respondent no.2.

3. Learned counsel for the petitioner, Ms.Kiran D. Pandey, submits that as the petitioner is a poor woman and she has no means to engage an advocate to prefer an appeal that she has approached the High Court Legal Services Committee for Page 1 of 2 Uploaded by R.S. Thus, the petitioner has satisfactorily explained the delay.

4. Therefore, the petition is allowed condoning the delay of 44 days in filing the appeal.
