The Hon'ble Court has thereby acquitted the original accused nos. 2 & 3 from the offence under Section 338 of IPC read with Section 34 of the IPC. The Hon'ble Court has further directed to refund the amount of fine to the original accused nos. 2 & 3, if deposited by them, and has also directed that the bail bonds be forfeited.
Rest of the judgement and order dated 11.10.1999 is confirmed. Criminal Appeal No. 1276 of 1999 is disposed of as abated qua accused no. 1 and is dismissed qua accused nos. 2 & 3 and Criminal Revision Application No. 582 of 1999 stands disposed of in view thereof. Criminal Appeal No. 1173 of 1999 and Criminal Revision Application No. 581 of 1999 are disposed of as abated.
