1. Though the learned advocate for the applicant has filed sick note, however, Mr. Shivam Joshi learned advocate submitted that he has an instructions to argue the application.

2. The present application has been preferred for seeking condonation of delay of 74 days caused in preferring the appeal against the impugned judgment and award.

3. Heard learned advocate for the applicant.

4. Learned advocate for the applicant submitted that the delay of 74 days has occasioned in preferring the appeal owing to the reasons that the applicant could not arrange the finance as the Insurance Company was exonerated. Having considered the submissions of the learned advocate for the applicant and having regard to the ground for delay pressed into service, I am of the considered view that the delay has been sufficiently explained and the same deserves to be condoned. Accordingly, the delay is condoned. No order as to costs.
