ORAL ORDER
1. Heard learned Advocate Mr.Jay S. Shah for the petitioner.
2. At the outset, learned advocate Mr.Shah states that during the pendency of the present writ application, the First Appeal in question is already dismissed by the Appellate Court. 2.1. Learned advocate Mr.Shah on instruction of his client further states that petitioners intends to challenge such judgment and decree passed by Appellate Court before this Page 1 of 3 Uploaded by MOHD MONIS(HC01900) on Mon Sep 22 2025 Downloaded on : Mon Sep 22 23:41:08 IST 2025 NEUTRAL CITATION C/SCA/11850/2025 ORDER DATED: 22/09/2025 undefined Court by way of Second Appeal. So, learned advocate Mr.Shah requests this Court that order impugned passed by Appellate Court and the issue germane in the present writ application may be allowed to be raised in the Second Appeal. 2.2. Learned Advocate Mr. Shah submitted a simple copy of judgment / decree passed by Appellate Court on 17.09.2025 passed by 4th Additional District Judge in Regular Civil Appeal No. 33 of 2009, which is taken on record.
3. Having heard learned Advocate Mr. Shah and as such the First Appeal filed by the petitioner itself is dismissed by the Appellate Court, as such, nothing further requires to be done in the matter.
4. At the same time, liberty is reserved in favour of the petitioner to raise an issue so agitated before this Court in the present writ application, to be agitated in the Second Appeal, as and when they chose to file Second Appeal.
5.
