1. Heard learned counsel for the applicant.
2. Learned counsel for the applicant, submitted that the delay of 49 days has occasioned in preferring the present appeal owing to the reason that the learned advocate was dealing with the case before the learned Tribunal and has not intimated regarding the passing of the judgment and award, therefore, the appeal could not be preferred in time. He further submitted that the delay is neither intentional nor malafide, but has occasioned owing to the reason mentioned in Paragraph No.3 of the application.
3. Having considered the submission of the learned counsel for the applicant and the ground for delay pressed into service, I am of the considered view that the delay has been sufficiently explained.
