1. Heard learned counsel for the applicant.

Learned counsel for the applicant, submitted that the delay in preferring the appeal against the impugned judgment and award dated 24.01.2025 passed in MAC Petition No.250/2018 has occasioned owing to the reason that the applicant could not collect the papers of the case to prefer the appeal. Therefore, the delay of 83 days has occasioned in preferring the appeal. He further submitted that the delay is neither intentional nor malafide but has occasioned owing to the reasons stated in Paragraph no.3 of the application.

Having considered the submission of the learned counsel for the applicant and having regard to the ratio of the judgment rendered by the Supreme Court in the case of Collector Land Acquisition, Anantnag and Another Vs. Mst.
