ORDER IN FIRST APPEAL NO.5117 OF 2008 Ms. Agneya Mankad, learned Assistant Government Pleader, appearing on behalf of the appellant State has submitted that she has received written instructions from the concerned authority to withdraw the present First Appeal, as the acquiring body has also preferred First Appeal being No.332 of 2008 against the judgment and award passed by the Reference Court, Godhra in Land Acquisition Reference No.154 of 1993 and, therefore, seeks permission to withdraw the present appeal.
Considering the above submissions, permission, as sought for, is granted. Learned counsel Mr. Vishal C. Mehta has submitted that, he had filed his Vakalatnama only in First Appeal No.5117 of 2008 and he has not filed his Vakalatnama in First Appeal No.332 of 2008.
Considering this, let he may file his Vakalatnama and get instructions before the next date of hearing.
