Learned advocate for the applicant upon instructions submitted that the present revision application has been preferred challenging the judgment of conviction under Section 138 of the Negotiable Instruments Act, 1881 and the said judgment of conviction has been confirmed by the learned Appellate Court and the present revision application has been preferred. Further, it is submitted that the present applicant was in judicial custody since 05.05.2023 and the sentence awarded by the learned Trial Court was 2 years and he already served the sentence and upon instructions, he does not want to proceed further and sought permission to withdraw the present revision application.
