                                                            ORAL ORDER

1. The present petition has been preferred by the petitioner under Article 226 of the Constitution of India challenging the judgment and order dated 10.10.2025 passed by the 6th Additional District Judge, Ahmedabd (Rural) below Commercial Execution No.21 of 2025, issuing the possession warrant against the award debtor.

2. Learned advocate Mr.Shashvata U. Shukla appears on caveat for the respondent no.1 and also filed affidavit- in-reply.

3. Learned Senior Counsel Mr.Dhaval D. Vyas appearing with learned advocate Mr.D.R. It is submitted by the learned advocates appearing for the respective parties that there is an understanding arrived at between the parties that as the possession of the premises has already been handed over to the respondent, who is an award creditor and as some equipment of the present petitioner are lying in the said premises, which was a running theater, on 24.10.2025, the present petitioner would be allowed to inspect the equipment lying in the said premises and from 27.10.2025, within 7 days between 9:00 a.m. to 6:00 p.m., the petitioner will carry out the process for removal of the equipment of the ownership of the petitioner in the presence of the respondent and considering the same, the present petition may be disposed of.

5. Considering the submissions made by the learned advocates for the respective parties and considering the understanding arrived at between the parties, the present petition is hereby disposed of. However, it is clarified that no further time shall be granted to carry out exercise, as mentioned above.
