1. The present petition is filed for the following prayers.
"(i) The petitioners are students of Respondent No.3 college who have passed from college and are local residents of Bhavnagar City. Respondent Nos.1 and 2 are the authorities of State of Gujarat responsible for the implementation of the policy of the Government of Gujarat; while Respondent No.5 is the Government of Gujarat and are as such amenable to the writ jurisdiction of this Hon'ble High Court. Respondent No.3 & 4 are the necessary parties to this petition;

(ii) Petitioners have completed their graduation and post graduation respectively from Respondent No.3 College. Recently, State Government of Gujarat invited applications for the recruitment of teachers of Secondary and Higher Secondary Schools. The forms were invited on-line. Petitioners have filled up their applicaions on-line with required details. A copy of the on-line form filled up by the petitioners are hereto annexed and marked as ANNEXURE-A(COLLY). On 28.02.2017, the officers of the State Government had called the various applicants for verification of documents at Majiraj Girls High School.
During this document verification, officers of the respondent department refused to recognize the degree of BA/MA of the present petitioners and their co-students for recruitment of Secondary and Higher Secondary Teachers for the reason that the coursses of respondent No.3 college and Respondent No.4 University, are not recognized by the State Government of Gujarat;

Government officers are not recognizing the courses of Respondent No.3 College. A copy of the letter written by the present petitioners to Respondent No.3 College dated 01.03.2017 is hereto annexed and marked as ANNEXURE-B ;
iv) Petitioners have received a letter from the College on 16.03.2017. A copy of the reply dated 16.03.2017 received by the petitioners is hereto annexed and marked as ANNEXURE-C. The college had responded that the college is affiliated with SNDT University with the knowledge of the State Government of Gujarat since 1951 and that they have represented to the State Government for immediately accepting the students of Respondent No.3 college having passed from the recognized University;
(v) It is to be noted that Respondent
No.3 college had already received

complaints from the other co-students of not recognizing their degrees and therefore, in fact, Respondent No.3 had already made a representation on 28.02.2017 to the State Government to consider the degree of the Respondent No.4 University as recognized for the purpose of recruitment of teachers in Secondary and Higher Secondary Education. Various communications done by Respondent No.3 college with the State Government is reflected in the letter dated 16.03.2017. However, it seems that while the State Government has not cleared its stand nor it has instructed the Director of Primary and Secondary-Higher Secondary Education Board to recognize the degree of graduation and post graduation of the students of Respondent No.3 college having affiliation with SNDT Women's University, Mumbai;
(vi) Petitioners state that, petitioners have passed their graduation and post graduation from Respondent No.3 college, which is carrying on its activity of imparting education for girls since 1951 at Bhavnagar City and having high reputation Page 4 of 22 Uploaded by SYED SHAHANAZ(HC02353) on Tue Oct 14 2025 Downloaded on : Tue Oct 14 23:30:04 IST 2025 NEUTRAL CITATION C/SCA/6584/2017 ORDER DATED: 09/10/2025 undefined in the surrounding areas in the education of women. If the degree of this college is not recognized, the petitioners would be put to great hardships and the future of the petitioner would be bleak;
(vii) Petitioners state that petitioners further consulted Respondent No.3 college and its office bearers. It was informed to the petitioners by the college that there was a decision of this Hon'ble High Court in a case wherein affiliation was sought by various new colleges with SNDT University respondent No.4 herein. However, on the ground of extra territorial operation, the Hon'ble Court has held that the State Government of Gujarat cannot be directed to issue No Objection Certificate to such colleges for affiliation with the University in the State of Maharashtra. However, the said decision did not deal with the colleges already having affiliation with SNDT University. Petitioners state that it was informed to the petitioners that the decision does not apply to the already existing colleges having affiliation with SNDT University. However, it has been perhaps wrongly interpreted by the State Government and arbitrarily refused to recognize the students who have already passed their graduation and post graduation from respondent No.3 college. Therefore it is become necessary to seek intervention of this Hon'ble Court."

Heard learned advocates Mr. Hemang Shah for the Petitioner No.1, Mr. Tanmay Karia for Petitioner No.2,learned AGP Mr. Henil Shah for Respondents No.1,2,5 and 6, Mr. Yogesh Ravani for the Respondent No.3 and Ms. Disha Nanavaty for Respondent No.4. At the outset, it is required to be noted that it is stated in affidavit-in-reply filed by the Swatiba K. Raval serving as Assistant Director Commissioner of School dated 24.07.2023 on behalf of Respondent No.2. in para 14 as under :
"14. It is respectfully submitted that for the sake of the argument, if the degree of Bachelor and Master obtained from the Page 6 of 22 Uploaded by SYED SHAHANAZ(HC02353) on Tue Oct 14 2025 Downloaded on : Tue Oct 14 23:30:04 IST 2025 NEUTRAL CITATION C/SCA/6584/2017 ORDER DATED: 09/10/2025 undefined SNDT University is to be considered in that case the total merit of the petitioner is 60.02% in SEBC female category in Social Science subject and the last candidate allotted in the recruitment from SEBC female in Social Science was 60.07%, in such circumstances also the petitioner No.2 is not entitled for appointment. Copy of the waiting list in Social Science is annexed herewith and marked as ANNEXURE-III."

In view of the specific statement made, to which the Petitioner No.2 is not in a position to controvert, the said averment for qua the petitioner No.2, the Petitioner No.2 is not required to be considered as he is not found eligible. Therefore, the matter is now considered for the Petitioner No.1. Mr. Shah for the petitioner has drawn my attention towards the provisions of the Government Resolution dated 26.11.2019, whereby the Deputy Secretary, Education Department, State of Gujarat has issued the Government Resolution by stating that the institutions which are affiliated Page 7 of 22 Uploaded by SYED SHAHANAZ(HC02353) on Tue Oct 14 2025 Downloaded on : Tue Oct 14 23:30:04 IST 2025 NEUTRAL CITATION C/SCA/6584/2017 ORDER DATED: 09/10/2025 undefined with the SNDT University, Mumbai, the said degree from such institutions should also be considered as recognised. He has further submitted that in addition to that in similarly situated matter, the Coordinate Bench of this Court in SCA No.16736 of 2017 has considered this aspect about the recognition of the SNDT University and after considering the same the Coordinate Bench has allowed the petition. The said order of SCA No.16736 of 2017 is also confirmed by the Division Bench in Letters Patent Appeal 915 of 2017 and therefore, he has submitted that the case of the petitioner can be considered accordingly by considering this specific provision in the Government Resolution and also considering the fact that the identical case is decided by the Coordinate Bench and prays to grant the necessary prayers. He has further submitted that while issuing the rule on 30.03.2017 the Court has passed a detailed order which is reproduced as under :

Respondents are directed to keep one post vacant.
Registry as well as respondents are directed to identify all such matters where same issue has arisen as in the present petition. All such matters are required to be listed together.
Respondents are specifically directed to depute an officer who has to remain present before the Court on next date to answer a query that when in Advertisement and also in Rules, when there is disclosure for educational qualification that to be eligible for appointment as teacher, a candidate shall possess the master's degree in Arts or Science or Commerce and a Bachelor's degree obtained from any of the Universities or Institutions established or incorporated by an Act of Parliament or a State Legislature in India or any other Educational Institution recognized as such by the Government or declared to be Page 9 of 22 Uploaded by SYED SHAHANAZ(HC02353) on Tue Oct 14 2025 Downloaded on : Tue Oct 14 23:30:04 IST 2025 NEUTRAL CITATION C/SCA/6584/2017 ORDER DATED: 09/10/2025 undefined deemed as University under Section 3 of the University Grant Commission Act, 1956 or possess an Equivalent Qualification recognized as such by the Government then why at the time of recruitment on different posts by different authorities, different views are being taken and why several petitioners have to challenge such act of the respondents repeatedly before this Court. Wherever recruitment process is ongoing, it would be appropriate for the respondent to allow the petitioner to compete in the recruitment process but to keep the result of the petitioner in a sealed cover till the next date of hearing.
Respondents are free to appoint such
persons on their own.
Considering the different petitions before this Court during last couple of weeks, it seems that respondents are lacking in disclosing their specific requirement at the time of advertisement for any such recruitment wherein if they want a teacher having a particular knowledge then they should have to specifically disclose in the advertisement that they want a graduate Page 10 of 22 Uploaded by SYED SHAHANAZ(HC02353) on Tue Oct 14 2025 Downloaded on : Tue Oct 14 23:30:04 IST 2025 NEUTRAL CITATION C/SCA/6584/2017 ORDER DATED: 09/10/2025 undefined in particular subject i.e. maths, science, biology etc. Parties shall complete their pleadings before the returnable date. Direct Service is permitted."
4. He has submitted that one post is kept vacant and therefore appropriate order may be passed.
5. Learned AGP Mr. Henil Shah has submitted that at the time when the process is initiated, which is subject matter of the petition, it is admitted that the SNDT University is not a recognised university. He has further submitted by referring to the affidavit-in-reply, that the petitioner has obtained a degree on Bachelor of Arts in Political Science and Master of Arts in Political Science from the Respondent No.3 which is affiliated with the SNDT University, Mumbai. He has further submitted that in view of the Government Resolution dated 01.09.2012 for the purpose of granting affiliation to the institutes affiliated with the SNDT University, it is resolved that affiliation of the institutes situated in the State of Gujarat affiliated with the SNDT University are required to be cancelled and those Page 11 of 22 Uploaded by SYED SHAHANAZ(HC02353) on Tue Oct 14 2025 Downloaded on : Tue Oct 14 23:30:04 IST 2025 NEUTRAL CITATION C/SCA/6584/2017 ORDER DATED: 09/10/2025 undefined institutes are directed to be affiliated themselves and obtain affiliation from any University situated in the State of Gujarat. He has further submitted that the UGC has also issued a public notice on 27.06.2013 wherein a clarification is issued to all the concerned including students and parents of the private university established and incorporated by or under a State only within a territorial jurisdiction alloted to it under and in no case beyond the territory of the State and its location and therefore, he has submitted that as such there is no error committed by the respondent-authority and accordingly prayers may not be considered. He has also drawn my attention towards the additional affidavit-in-reply filed by him whereby he has relied on judgment in LPA No.799 of 2021 whereby it is held that the basis where a student has undergone distant learning course from SNDT University could not be considered as a valid recognition. Therefore, he has submitted that no relief can be granted.

Learned advocate Mr. Ravani has pointed out that now Respondent No.3 is also affiliated with the Bhavnagar University in 2018 and in fact, the petitioner have attended the college and taken regular course in Respondent No.3 as a regular student and therefore in view of the subsequent Page 12 of 22 Uploaded by SYED SHAHANAZ(HC02353) on Tue Oct 14 2025 Downloaded on : Tue Oct 14 23:30:04 IST 2025 NEUTRAL CITATION C/SCA/6584/2017 ORDER DATED: 09/10/2025 undefined Government Resolution as well as the judgment in SCA which is relied by the petitioner which is applicatble to the facts of the case, appropriate order may be passed. I have considered the submissions made at the bar by respective advocates. I have also considered the fact that the Petitioner No.1 has taken actual education as a regular student with a Respondent No.3 college which is affiliated with the SNDT University and now affiliated with the Bhavnagar University. It also transpires that by way of Government Resolution dated 26.11.2019 issued by the Deputy Secretary, Education Department, it is specifically considered that the institution which has got affiliation from the SNDT Women's University, Mumbai. The students who have obtained degree from such institution should be recognised. In the judgment relied on by learned advocatefor the petitioner, the Coordinate Bench in SCA No.16736 0f 2017 has held in Para 2 and 3 as under :
"(2) By way of this petition under Article 226 of the Constitution of India, the prayer of the petitioner is to direct the respondents to accept the graduation degree and consider the marks of the petitioner of Bachelor of Arts Degree that Page 13 of 22 Uploaded by SYED SHAHANAZ(HC02353) on Tue Oct 14 2025 Downloaded on : Tue Oct 14 23:30:04 IST 2025 NEUTRAL CITATION C/SCA/6584/2017 ORDER DATED: 09/10/2025 undefined the petitioner has secured from the SNDT University as valid for the post of appointment to the post of Vidya Sahayak.
The facts in brief are as under:
2.1 The office of the respondent No.2, Director of Primary Education, published an advertisement on 01.09.2017 for recruitment to the post of Vidya Sahayaks for primary section standard one to five. 2.2 The petitioner had a degree of PTC and had cleared TAT examination. She had attained the degree of Bachelor of Arts from SNDT Women University. She applied for being considered for selection to the post of Vidya Sahayak.
2.3. The case of the petitioner is that though her Bachelor of Arts degree was recognized by the UGC, inasmuch as, the SNDT University is a university recognized by the UGC, the respondents refused to consider her qualification in the Bachelor of Arts course as valid. The stand of the department appears to be that since the Page 14 of 22 Uploaded by SYED SHAHANAZ(HC02353) on Tue Oct 14 2025 Downloaded on : Tue Oct 14 23:30:04 IST 2025 NEUTRAL CITATION C/SCA/6584/2017 ORDER DATED: 09/10/2025 undefined petitioner has undergone her course from an open and distance learning institute from outside the State, she could not be considered as eligible for being appointed.
3. On 12.09.2017, this Court while entertaining the petition, passed the following order:
"Heard learned advocates for the respective parties. Considering the facts and circumstances, let there be a direction to the respondent/s to allow the petitioners in the respective petitions to compete in the competitive examination for recruitment of the concerned post/s irrespective of objection by the respondent/s regarding their degree certificates. However, it is made clear that the petitioners in the respective petitions have to produce all relevant documents directly before the respondent/s. Respondent/s shall accept such certificates and shall allow the petitioners in respective petitions to compete in the recruitment process. 7. In the similar set of facts the Court has considered the case of the petitioner in that matter and granted the relief accordingly by allowing the petition. The facts of the present case are similar to the above mentioned judgment. Therefore, I am of the view that the judgment which is relied by learned AGP Munshaw in LPA No. 799 of 2021 pertains to distance learning course and in the present case, the case is about the regular student and therefore the said judgment in LPA No.799 of 2021 is not applicable to the facts of the present case. Considering the same, I am of the view that on all these grounds, the objection raised by the State that the petitioner should not be made the beneficiary of the policy of 26.11.2019 is required to be rejected.
8. Thereafter, for the above mentioned reasons the petiion is allowed qua the petitioner No.1. The respondents are directed to appoint the Petitioner No.1 pursuant to the selection that the respondents have undertaken. Considering the interim relief granted at the time of issuance of rule, one post is already kept vacant and therefore let the necessary procedure shall be undertaken forthwith. Rule is made absolute to the aforesaid action. Direct service is permitted.
