ORAL ORDER
1. Learned advocate Mr. Ramnandan Singh for the petitioner placed on record the judgment and order delivered by the Additional District and Sessions Judge, Ahmedabad (Rural ) Atrocity Case No. 50 of 2017 which arise from the C.R No. 137 of 2017 registered with Sarkej Police Station quashment of which is sought by way of this petition.
2. Since the learned Court below has acquitted the petitioner on the ground that complainant being turned hostile. The same issue operates in favour of the petitioner and therefore, continuation of the FIR therefore would be abuse of process of law. This Court has taken on record the judgment of 8th Additional District and Sessions Judge Ahmedabad (Rural) Mirzapur, Ahmedabad in Atrocity Case No. 50 of 2017 and also perused the reasoning and finding Page 1 of 2 Uploaded by MARY VADAKKAN(HC00204) on Sat Oct 04 2025 Downloaded on : Sat Oct 04 11:08:01 IST 2025 NEUTRAL CITATION R/SCR.A/6873/2017 ORDER DATED: 03/10/2025 undefined recorded by the learned Trial Court acquitting the other accused having a major reason of the complainant turning hostile.
3. In view of above, the petition deserves consideration and is required to be allowed and is accordingly allowed.
4. This petition is allowed. The impugned FIR being C.R No. I 137 of 2017 registered with Sarkhej Police Station, Ahmedabad and all the consequential proceedings arising therefrom qua the petitioner is quashed and setaside.
