1. Mr. Kamlesh Kotai, learned advocate appearing for the applicant submits on record an affidavit of the respondent no. 2 - original complainant who is present before the court today. He has been duly identified by Mr. Kamlesh Kotai, learned advocate for the applicant. Respondent no. 2 - original complainant has filed an affidavit wherein, he has stated that, he has received the entire amount of consideration and that, he does not wish to proceed with the litigation. He has also stated that, he has no objection if the conviction is quashed and set aside. The affidavit is taken on record.
2. In view of the settlement arrived at between the parties and in view of the fact that, now the original complainant does not want to continue with the proceedings, the impugned order and judgment of conviction dated 18.02.2025 passed by the 3 rd Additional Sessions Judge, Page 2 of 3 Uploaded by DIVYA PILLAI(HC00199) on Wed Nov 26 2025 Downloaded on : Wed Nov 26 22:15:45 IST 2025 NEUTRAL CITATION R/CR.RA/2295/2025 ORDER DATED: 26/11/2025 undefined Sabarkantha in Criminal Appeal No. 37 of 2022 and order dated 14.03.2022 passed by the Additional Chief Judicial Magistrate, Idar in Criminal Case No. 330 of 2017 as well as consequential proceedings arising therefrom are hereby quashed and set aside qua the applicant. The applicant who is in jail shall be released forthwith, if not required in connection with any other case.
3. In view of the aforesaid settlement between the parties, present revision application is disposed of. In view of disposal of main revision application, all connected applications also stand disposed of. The Registry is directed to transmit the record and proceedings to the Tribunal forthwith, if any. Direct service is permitted today.
