ORDER IN R/CIVIL APPLICATION (FOR CONDONATION OF DELAY) NO. 3299 of 2024

1. This is an application filed by the applicant under Section 5 of the Limitation Act for condonation of delay of 77 days occurred in filing the fist appeal challenging the judgment dated 27.10.2023 and award dated 04.11.2023 passed by the learned 6th Additional Senior Civil Judge, Ahmedabad (Rural), Navrangpura in Land Acquisition Reference No.131 of 2003.

2. Considering the explanation offered in the application, this Court deems it fit to allow this application.

3. Hence, this application is allowed. Delay of 77 days occurred in preferring the first appeal is condoned. Rule is made absolute accordingly.

1. This application is filed for condonation of delay of 452 days caused in preferring the application for bringing heirs of deceased claimant, namely, Prajapati Shailesh Revabhai. Learned advocate Mr.Mehta submits that in the cause title of the Reference Court the name of the deceased is mentioned Shaileshbhai Revabhai Prajapati however, as per the death certificate his name is Shaileshbhai Bababhai Prajapati. Learned advocate Mr.Mehta submits that along with this application the statement of heirs are also taken as well as pedigree is also annexed with the application.

2. Learned advocate Mr.Pandya appearing for the heirs of the deceased does not dispute the above aspect.

3. Considering the explanation offered in the application as well as considering the submissions, this Court deems it fit to allow this application.

4. Resultantly, application for condonation of delay of 452 days is allowed. The heirs are permitted to bring on record.
