ORAL ORDER
Present application is filed under Section 5 of the Limitation Act seeking condonation of delay of 34 days caused in preferring the order passed by the learned first appellate Court rejecting the delay condonation application caused in preferring the appeal against the judgment and order of conviction and sentence.
2. Learned advocate for the petitioner has submitted that petitioner is at present in judicial custody and therefore facing some difficulties to challenge the impugned order. It is submitted that due to this reason the delay of 34 days has been caused in preferring the revision application and therefore the same may be condoned.
3. Learned APP for the respondent - State would submit that considering the facts and circumstances of the case, appropriate order may be passed.

Having heard the learned advocates appearing for the respective parties and considering the averments made in the application and the fact that petitioner is behind the bar in view of the conviction and sentence imposed upon the petitioner by the learned Court below, the delay of 34 days caused in preferring the revision application is condoned.
