1. Heard Mr.B.K. Raj, learned counsel for the appellant, Mr.Malhar Parmar, learned counsel and Mr.Neel Solanki, learned counsel for the respondents.

2. Challenge in this appeal, at the hands of wife, is to the judgment and decree of the learned Family Court by which, the learned Family Court granted a decree of divorce in favour of the respondent.

3. When the matter is taken up today, both the learned counsels state that the appellant and the respondent are present in the Court and are identified by them. Mr.B.K. In light of this, he has instructions to withdraw the appeal.

4. Mr.Malhar Parmar, learned counsel and Mr.Neel Solanki, learned counsel confirms that the amount of Rs.13 lacs has been paid by way of a cheque to the appellant and the cheque has already been honoured. This statement has not been disputed by the learned counsel for the appellant.

5. In light of this settlement arrived at between the parties and on instructions to the appellant's advocate to withdraw the appeal, the appeal is disposed of as withdrawn in presence of the parties.
