Heard learned advocate Mr. Japan V. Dave for the petitioners and learned advocate Mr. K. V. Shelar for the respondent.
At the outset, learned advocate Mr. Dave would submit that during pendency of present writ application, the suit is proceeded further and after by-parte hearing, the trial court has kept the matter for judgment.
In view of the aforesaid, learned advocate Mr. Dave, under the instructions of his client, does not invite the order on merits and request this Court to pass an appropriate order.
As the suit itself is on the verge of pronouncement of judgment by the trial Court, this Court would not like to disturb the order impugned in the present writ application.
