ORAL ORDER
1. Rule. Learned APP waives service for the respondent - State.
2. The present application has been preferred to condone the delay of 70 days in challenging the order passed by the learned Additional District Judge, Vadodara in ACB Case No.04 of 2013 & 01 of 2015.
3. Heard learned APP Ms. Jyoti Bhatt and it is submitted by her that there is a delay of 70 days in preferring the revision Page 1 of 3 Uploaded by MR.JAIMIN CHANDRAKANTBHAI PRAJAPATI(HCD0066) on Tue Jul 01 2025 Downloaded on : Wed Jul 02 02:00:58 IST 2025 NEUTRAL CITATION R/CR.MA/12587/2024 ORDER DATED: 30/06/2025 undefined application which is unintentional and the delay has been caused because of the ministerial permission from the concerned department.
4. On the other hand, learned advocate for the respondent vehemently opposed and submitted that no sufficient cause has been shown to condone the delay and the application is required to be rejected.
5. After hearing learned advocate for respective parties and perusing the contentions made in the application, as per the catena of the judgment of the Hon'ble Apex Court, when the technicality has been treated against the substantial justice, then, the Court has to prefer substantial justice. Further, the reason stated in the application is found to be genuine and satisfactory to this court. Delay is to be condoned.
6. Accordingly, the present application stands allowed.
7. Delay of 70 days in preferring the criminal revision application is to be condoned.
