(PER : HONOURABLE MR. JUSTICE A.Y. KOGJE) The present application is filed seeking restoration of main matter, which came to be dismissed for want of prosecution by order dated 10.06.2025.
Learned Advocate for the applicant submitted that in fact, the main matter was argued before the Court in the first half on 10.06.2025 and for production of judgments, learned Advocate had asked for time. The Court had therefore kept the matter in the second half. However, due to misconception that the matter is adjourned for 12.06.2025, learned Advocate did not remain present and that is how the matter came to be dismissed for default.
In view of the aforesaid, the application is allowed.
