1. Heard Mr. Sandeep Chavda, learned advocate appearing on behalf of Mr. Hemal Shah, learned advocate on record for the applicants - original claimants.

2. Issue Rule, returnable forthwith. Looking to the minimum number of days involved in preferring the appeal, the present application is taken up for final hearing in absence of the respondents.

3. At the outset, learned advocate has invited my attention to the averments made in the application. Learned advocate has submitted that the impugned judgment and award was Page 1 of 2 Uploaded by MAYA S. He has further pointed out that the applicants were advised to approach in appeal. The applicants were required to make arrangement for the Court fees. In the process, the delay of 17 days has crept in preferring the present appeal. By making aforesaid submission, learned advocate has submitted that the applicants has good case on merits and the delay resulted in approaching this court is bonafide. Learned advocate has therefore urged this court to condone the delay and to admit the appeal.

Considering the aforesaid submissions of the learned advocate for the applicant and the averments made in the application in the opinion of this court, sufficient cause is made out to consider the case for condonation of delay. Hence delay caused in preferring the captioned appeal is hereby condoned. Rule is made absolute.
