1. This Appeal arises against an order passed under the Guardians and Wards Act, 1890, whereby the custody of the minor child is ordered to be handed over to mother and visitation rights has been granted to father.

2. Today, when the matter is taken up, both the parties have submitted that they have reconciled their differences and as a matter of facts, husband and wife have decided to live altogether.

Terms of Settlement arrived at by them is also drawn out and filed in the Court.

3. Said Consent Terms of Settlement reads as follows:

"1. We the appellant and the opponent/respondent most respectfully say and submit as under:
2. We the undersigned appellant and opponent hereby mutually and amicably accept agree and confirmed and declare that, on this consent terms we withdraw all objections and allegations in the present subject matter pertaining to custody of our minor son namely -- Mohit and have decided to put end the present litigation.
3. That, the undersigned most respectfully say and submit that, we have decided to live together as husband and wife along with the minor son and we agree to withdraw all the legal contentions in the present First Appeal. Except this First Appeal no other proceedings are pending before this Honourable Court.
4. We the undersigned have agreed not to initiate any future proceedings pertaining to the custody of minor son namely Mohit.
5. In the aforesaid terms the First Appeal may be disposed off by confirming the Judgment and order dated 29.11.2023 passed by the Learned Judge Family court No.5 Ahmedabad in Civil Misc. Application No.10 of 2020."

4. In light of the Settlement arrived at between the husband and wife, this appeal has become unnecessary and is disposed of in terms of Consent Terms of Settlement arrived at between the parties.

5. In view of the order passed in the main Appeal, Civil Application No.1 of 2024 stands disposed of accordingly.
