1. By this application, the applicants have prayed for condoning the delay of 130 days caused in preferring the captioned first appeal.
2. Mr.MH Qureshi, learned advocate for Mr.Premal Joshi, learned Advocate for the applicants has made submission along the lines of the averments made in the application. It is submitted that steps were taken after the pronouncement of the judgment; however, some time got consumed in preparing and finalising the appeal. It is urged that the delay is bona fide which may kindly be condoned.
3. Mr.Vimal Patel, learned Advocate appearing for VMP Legal for the respondent no. 7 has urged that appropriate order may be passed.

4. Having regard to the averments made so also the oral submissions and explanation offered, this Court, is of the opinion that delay of 130 days caused in filing the captioned appeal is sufficiently explained and deserves to be condoned and is hereby condoned.
5. Civil application succeeds and is accordingly allowed. Rule is made absolute. No order as to costs.
