1. The Criminal Appeal No.418 of 2005 has been preferred by the appellant-original accused under Section 374 of the Code of Criminal Procedure, 1973, against the judgment and order of conviction and sentence; whereas, the Criminal Appeal No.104 of 2006 has been preferred by the State under Section 377 of the Code of Criminal Procedure, 1973, for enhancement of the sentence imposed against the present appellant-accused vide judgment and order of conviction and sentence dated 16.02.2005 passed by the learned Special Judge and Additional Sessions Judge, Fast Track Court No.6, Jamnagar, in Special Page 1 of 3 Uploaded by M.A. SAIYED(HC00172) on Wed Jul 09 2025 Downloaded on : Wed Jul 09 22:41:33 IST 2025 NEUTRAL CITATION R/CR.A/418/2005 ORDER DATED: 09/07/2025 undefined Case No.11 of 1998, whereby the learned Special Judge convicted the present appellant-accused for the offence punishable under Sections 7 and 13(2) of the Prevention of Corruption Act, 1988, and consequently, sentenced him to undergo rigorous imprisonment for a period of two years along with fine of Rs.1,000=00, and in making default of payment of fine, to undergo further imprisonment for six months.
2. Today, learned APP Ms.Asmita Patel appearing for the respondent-State has tendered a report dated 12.02.2025 addressed to the Superintendent, Additional Sessions Court, Jamnagar, by Shri P.R.Jadeja, A.S.I., A.C.B. Police Station, Jamnagar, along with a copy of the death certificate of the appellant-original accused, namely, Navinchandra Shankarlal Thakar, which are ordered to be taken on record.
3. Upon perusing the death certificate, it appears that the appellant-original accused - Navinchandra Shankarlal Thakar has expired on 05.04.2014.
4.
