ORAL JUDGMENT
1. Present appeal is filed by the appellant challenging the impugned judgment and award dated 9.3.2011 passed by the learned Workmen Compensation Commissioner, Ahmedabad in Workmen Compensation Application No. 31 of 2006, whereby the Workmen Commissioner has Page 1 of 3 Uploaded by SURESH SOLANKI(HC00208) on Tue Jul 08 2025 Downloaded on : Tue Jul 08 23:49:55 IST 2025 NEUTRAL CITATION C/FA/1986/2012 JUDGMENT DATED: 08/07/2025 undefined awarded compensation to the tune of Rs. 2,77,565/- along with appropriate interest and penalty.
2. Though various grounds have been raised in the memo of appeal, the fact remains that the total amount involved in the appeal is very small. Considering the smallness of amount, this Court is of the opinion that the appeal is not required to be entertained. Accordingly, only on the ground of smallness of amount with a further clarification that this may not be considered as precedent in other claim petitions arising out of the same accident, the appeal is dismissed. However, there shall be no order as to costs. Registry is directed to send the original record and proceedings back to the Tribunal forthwith.
3. The amount deposited by the appellant before the learned Commissioner shall be disbursed in favour of respondent along with interest accrued on it, after due verification through R.T.G.S./N.E.F.T., within period of eight weeks from the date of receipt of copy of present order.
