Mr. Rohan G. Vaghela, learned advocate for Mr. Pravin Gondaliya, learned advocate for the appellant, on instructions from his client, who is appellant herein, challenging the judgment and order of acquittal recorded in favour of the respondent - accused where appellant was original complainant prosecuting respondent for an offence punishable under Section 138 of the Negotiable Instruments Act, 1881, submits that sole respondent - accused has expired.
In view of the fact that the sole respondent has expired, this Appeal would abate on the death of the sole respondent.
