ORAL ORDER
On soft copy being supplied, of the death certificate of sole respondent No. 2 - accused, to the advocate for the appellant as also learned APP, which is verified through the In-Charge Police Inspector, Modhera Police station - Shri S.R. Modi.
Pursuant thereto, Shri Modi, In-charge Police Inspector, Modhera Police station has forwarded a copy of the death certificate issued by Mehsana Nagarpalika and a certificate issued by Talati-cum-Mantri of Motap Gram Panchayat, Taluka:

Said certificate is issued pursuant to presentation of pedigree earlier as also copy of death certificate.
The report addressed to the office of the Government Pleader, High Court of Gujarat along with copy of death certificate and the certificate issued by Talati-cum-Mantri of Motap Gram Panchayat are ordered to be taken on record.
Since sole respondent - accused has expired, this appeal challenging judgment and order of acquittal recorded in favor of respondent No. 2 for an offence punishable under Section 138 of the Negotiable Instruments Act, 1881 stands abated.
In view thereof, this appeal stands disposed of having been abated.
