The present application is filed to condone the delay of one day in filing the application for restoration of F/Second Appeal No.5375 of 2024.
Learned advocate for the applicant has fairly stated that as the certified copy of the judgment and decree of the trial Court was not available, and therefore, the application could not be filed within the prescribed period of limitation.
Learned advocate Mr. Nirad D. Buch for respondent has no objection if the present application is allowed.
Having heard learned advocate for the parties and having considered the averments made in the application. Sufficient reasons have been given to condone the delay. Hence, the present application is allowed. The Delay of one day is hereby condoned.
