None appears for the revision applicant.
On perusal of the papers, it is seen that pursuant to the FIR dated 12/12/2010, the revision applicant was arrested for offences under Sections 377, 511, 323, 506(2), 504, 292 and 293 of the Indian Penal Code.
By way of judgment and order dated 28/01/2011 of the Chief Judicial Magistrate, Amreli, the revision applicant was convicted for the offence under Section 377, 511 and 506 only of the Indian Penal code and acquitted from the rest of the charges and was awarded simple imprisonment of five years with a fine of Rs.1,000/- and in default there of a further one Page 1 of 2 Uploaded by PATEL ILA KANTIBHAI(HC00194) on Fri Feb 21 2025 Downloaded on : Sat Feb 22 02:59:31 IST 2025 NEUTRAL CITATION R/CR.RA/382/2011 ORDER DATED: 21/02/2025 undefined month simple imprisonment. His Criminal Appeal was dismissed by the learned Sessions Judge, Amreli.
Eventually, this Court, by order dated 17/07/2024 passed in Criminal Misc. Application (For Regular Bail) No.10569 of 2014 in Criminal Revision Application No.382 of 2011, released the revision applicant on bail with only four months of sentence remaining on the said date.
In such view of the matter, this Court deems it fit that it would be appropriate and in the interest of justice if the conviction is maintained but the sentence is reduced to the period already undergone.
Accordingly, the present Criminal Revision Application succeeds to the above extent and disposed of. Rule is answered accordingly.
In view of aforesaid, Criminal Misc. Application No.1 of 2013 also stands disposed of.
