ORAL ORDER
1. The present Second Appeal has been filed against the judgment and decree passed by the learned 5 th Additional (Adhoc) District Judge, Nadiad in Regular Civil Appeal No.3 of 2008. The said appeal has been admitted by Coordinate Bench of this Court vide order dated 02.04.2013. The Court had issued notice to the appellant and the same has returned back with endorsement that the only appellant has expired.
2. In view of the above, and since no legal heirs of the appellant is / are jointed as party respondent, nor any mention is made in that regard when the matter is called out, the proceedings of appeal are hereby abated. The present appeal is disposed of accordingly.
