1. By this application, the applicants have prayed for condoning the delay of 35 days caused in preferring the captioned first appeal.
2. Mr M. H. Parekh, learned advocate for Mr Nishit A. Bhalodi, learned advocate for the applicants has made submissions along the lines of the averments made in the application and specially paragraph 3 of the application. It is submitted that the responsibility of the whole family now had come upon the applicant no.1. It is submitted that steps still were taken promptly so as to see that the appeal is filed in time. Despite putting sincere and several efforts, the appeal could be filed with a delay of 35 days. It is urged that the delay may kindly be condoned it being bona fide.
3. Heard Mr M. H. Parekh, learned advocate for Mr Nishit A. Bhalodi, learned advocate appearing for the applicants.
4. Against the judgment dated 12.06.2025 the captioned appeal is filed. In the opinion of this Court, the delay is explained. Considering the quantum, this Court, is of the opinion that delay of 35 days caused in filing the captioned appeal deserves to be condoned and is hereby condoned.
5. Civil application succeeds and is accordingly allowed. No order as to costs.
