ORAL ORDER
1. This petition is filed by the petitioner for following reliefs:-
[A] This Hon'ble Court may be pleased to admit and allow the present petition;
[B] This Hon'ble Court may be pleased to quash and set aside the F.I.R. bearing no.11192030220291/2022 dated 11.07.2022 registered with the Kanbha Police Station, Ahmedabad Rural for the offences punishable under Sections 65 a , 65(e), 116-b and 81 of The Prohibition Act and chareesheet and all consequential proceeding arising from this F.I.R. qua the present Petitioner in the interest of justice;
[C] That pending the admission, hearing and final disposal of this petition, the Hon'ble Court may be pleased to stay the further proceedings of Criminal Case No.17437 of 2022 pending before the Add. 2. This Court had issued rule under order dated 03.01.2023 and since then the matter is pending. It appears that as there was no stay on the proceedings and the trial has proceeded and the petitioner was tried as accused No.5 in Criminal Case No.17437 of 2022 arising out of Prohibition C.R.No. 11192030220291 of 2022 registered with Kanbha Police Station, Ahmedabad Rural under Section 65(A)(E), 116(B) and 81 of the Gujarat Prohibition Act.
3. Learned Additional Public Prosecutor has placed on record the decision in the aforesaid Criminal Case dated 12.09.2024, which has resulted in acquittal of the accused persons, including the present petitioner. A copy of the judgment is taken on record.
4. In view of the aforesaid, the present petition is rendered infructuous. Hence, the petition stands disposed of accordingly. As the order is passed in absence of learned advocate for the petitioner, liberty is reserved in favour of the petitioner to revive in case of difficulty.
