1. Today, twice the matter is called out however, Mr. Hardik H. Pandit, learned advocate for the petitioner has chosen not to remain present before this Court.

2. Learned AGP has submitted that out of Rs.16,00,000/- (Rupees Sixteen Lakhs), Rs.13,00,000/- (Rupees Thirteen Lakhs), is already paid to the petitioner and the petitioner has not availed the remedy of filing Civil Suit. Learned AGP has placed reliance on the judgment of the Apex Court in the case of Director General of Agriculture & Ors. Vs. M.V. Ramachandran, 2023 LiveLaw (SC) 220.

3. Since, Mr. Hardik H. Pandit, learned advocate for the petitioner has not remained present before this Court, the present petition is dismissed for non-prosecution.
