ORAL ORDER
1. Present appeal is filed by the appellant under Section 96 of the Civil Procedure Code, 1908 against the judgment and decree dated 25.10.2005 passed by the learned City Civil Judge, 4th Court at Ahmedabad in Civil Suit No.2732 of 1989.
2. When the matter is taken up for hearing, learned advocate for the appellant has submitted that the sole appellant - Bhanuprasad Kalidas has passed away and he has no instructions with regard to the legal heirs of the deceased appellant.
4. In view of above, the present appeal is dismissed for want of prosecution under Order 41 Rule 17 of Civil Procedure Code, 1908. No order as to costs. Record and proceedings, if any, be sent back to the concerned Court forthwith.
5. In case of any difficulty, it is open for the appellant to revive his request.
