1. Though served, none has appeared on behalf of the respondents No.1.
2. Having heard the learned AGP and considering the uncontroverted averments made in the application, more particularly, paragraph No.3 to 6 which are quoted hereunder, the delay of 244 days caused in preferring the captioned appeal is condoned.
"3. The Applicants state that after the passing of the impugned judgment dated 25.07.2024, the office of the Deputy Executive Engineer, National Highway Sub-Division, Tharad, vide communication dated 05.08.2024,made proposal for approval tofile an LPA addressing Office of the Executive Engineer, National Highway Department, Gandhidham.
4. On 08.08.2024, the Office of the Executive Engineer, National Highway Department, Gandhidham, forwarded a proposal for filing Page 1 of 2 Uploaded by SOMPURA MANISHKUMAR JYOTINDRA(HC00189) on Mon Aug 11 2025 Downloaded on : Mon Aug 11 22:39:34 IST 2025 NEUTRAL CITATION C/CA/2746/2025 ORDER DATED: 11/08/2025 undefined an LPA through a letter addressed to the Office of the Superintendent Engineer, National Highways, Circle Office, Gandhinagar.
5. Through a letter dated 09.08.2024, the Office of the Superintendent Engineer, National Highways, Circle Office, Gandhinagar, forwarded permission for filing the LPA to the Section Officer, Roads and Building Department, Branch, Sachivalaya, Gandhinagar. G-2
6. Subsequently, the file was processed at various levels before the competent authorities, undergoing scrutiny and necessary approvals within the administrative contributed hierarchy, which to the time taken in securing the final permission."
3. Accordingly, the civil application is disposed of. Registry to give regular number to the captioned appeal and list the same today itself.
