ORAL ORDER
Present cross objection is preferred by the original claimant - respondent in the First Appeal No.7588 of 1999, which was originally filed by the State of Gujarat and the Division Bench, after hearing both the parties, has partly allowed the said appeal and reduced the claim amount of Rs.160/- per Sq. Mtr. vide order dated 23.8.2011 passed in First Appeal Nos. 7586 of 1999 to First Appeal No.7590 of 1999.
Unfortunately, present cross objection was not tagged with the said First Appeals and therefore, it remains as it is.
Ms. Patel, learned AGP has produced the copy of the judgment of the Division Bench dated 23.8.2011 passed in First Appeal Nos. 7586 of 1999 to First Appeal Page 1 of 2 Uploaded by SURESH SOLANKI(HC00208) on Thu Aug 07 2025 Downloaded on : Thu Aug 07 21:54:28 IST 2025 NEUTRAL CITATION C/X-OBJ/333/2001 ORDER DATED: 06/08/2025 undefined No.7590 of 1999, wherein on perusal paragraph No. 15 of the order, it appears that the Division Bench of this Court has reduced the claim amount of Rs.160 per sq. Mtr.
Mr. Parikh, learned counsel, submits that the original claimant - respondent, who had preferred the present cross objection, passed away during its pendency. He further submits that the amount awarded, as per the order passed by the Division Bench of this Court, has already been received, and therefore, the present cross objection does not survive and may be disposed of as infructuous.
Considering the facts and circumstances of the case and on perusal of the order passed by Division Bench of this Court, present cross objection stands disposed of as having become infructuous.
