ORAL ORDER
1. State has preferred this appeal under Section 378(1)(3) of the Code of Criminal Procedure, 1973 (for short 'the Code, 1973') against the judgment and order of acquittal dated 30.03.2012 passed by the 6th Additional Sessions Judge, Surat in Sessions Case No. 18 of 2022.
2. Learned Assistant Public Prosecutor Mr. Hardik Soni for the appellant - State at the outset submitted that the sole respondent (original accused) expired on 10.04.2022. Learned APP further submitted that report of the Investigating Officer dated 01.08.2025 and the statements of relatives dated 01.08.2025 along with death certificate is also placed on record.
3. In view of above, the proceeding stands abated and the present appeal is disposed of accordingly.
