1. By this application, the applicant has prayed for condoning the delay of 49 days caused in preferring the captioned first appeal.

2. Ms Jirga D. Jhaveri, learned advocate for the applicants submitted that the judgment was pronounced on 28.08.2024. It is thereafter, the file was received by the Legal Department somewhere in the month of August 2024 and thereafter, as per the procedure it was sent to the Deputy Assistant Tax Collector in the month of September 2024. Necessary steps were taken of engaging the lawyer and allotting the matter. After gathering necessary instructions, preparing the file, the appeal came to be filed. In the process, there occurred a delay of 49 days.

4. Having regard to the averments made so also the oral submissions and considering the explanation offered, this Court, is of the opinion that delay of 49 days caused in filing the captioned first appeal deserves to be condoned and is hereby condoned.

5. Civil application succeeds and is accordingly allowed. Rule is made absolute to the aforesaid extent. No order as to costs.
