Learned advocate Ms. Prachi Upadhyaya on behalf of learned advocate Mr. Vaibhav A.Vyas appearing for the private respondents has submitted that the issue is squarely covered by the order dated 17.01.2025 passed by the Co- ordinate Bench in Civil Application (For Condonation of Delay) No.5491 of 2024 and the order dated 17.01.2025 passed in Civil Application (For Condonation of Delay) No.5538 of 2024. It is submitted that both these orders emanate from the same Page 1 of 3 Uploaded by MR PANKAJ KUMAR PRASAD(HC00967) on Thu Apr 24 2025 Downloaded on : Fri Apr 25 00:59:05 IST 2025 NEUTRAL CITATION C/LPA/686/2024 ORDER DATED: 23/04/2025 undefined judgment and order dated 19.10.2022 passed by the learned Single Judge in the group of petitions. It is submitted thus, the present appeal may be disposed of in terms of the orders passed by the Co-ordinate Bench.
2. Learned advocate Ms. R.V. Acharya appearing for the respondent No.74 is unable to dispute the same and has submitted that the present appeal may be disposed of in terms of the aforesaid order.
3. In the present Letters Patent Appeal, the appellant has assailed the judgment dated 19.10.2022 passed by the learned Single Judge in group of petitions being Special Civil Application No.15536 of 2022 and allied matters.
4. The District Development Officer assailed the aforesaid judgment by filing Letters Patent Appeal No.1401 of 2023 and Letters Patent Appeal No.1306 of 2023. It appears that the same were disposed of by the Co-ordinate Bench and thereafter, the review applications were filed in which there were delay, the Co-ordinate Bench vide orders dated 17.01.2025 passed in Civil Application (For Condonation of Delay) No.5491 of 2024 and Civil Application (For Condonation of Delay) No.5538 of 2024, has dismissed the review applications by refusing to condone the delay.
5. Thus, on an identical issue and on the very same judgment, the Letters Patent Appeals are already dismissed and against the same in the review applications, the delay is not condoned by the Co-ordinate Bench. The same is also dismissed in terms of the order dated 23.04.2024 passed by the Co-ordinate Bench in Letters Patent Appeal No.1401 of 2023 and Letters Patent Appeal No.1306 of 2023.
6. As a sequel, the connected Civil Application stands disposed of.
