ORAL ORDER
The present application has been filed to condone the delay of 56 days in filing the Second Appeal challenging the judgment and order dated 13.09.2024 passed by Principal District Judge, Bhavnagar in Regular Civil Appeal No.31 of 2019.
The learned advocate for the applicant has stated that applicant - Sidsar Seva Sahkari Mandali soon after the judgment and order the certified copy of the judgment and order is received by the learned advocate and after taking legal advice and after meeting of executive committee, file the present Second Appeal.
In view of the said fact, delay of 56 days in preferring the Second Appeal and the cause for delay has been explained in the Page 1 of 2 Uploaded by MANOJ KR. Learned advocate for the respondent has argued that the reasons is not valid reasons stated in the application to condone the delay. In view of the said fact the delay may not be condoned.
Having heard learned advocates for the parties and having gone through the application, more particularly, the reasons mentioned in the application, present application is allowed. The delay of 56 days is hereby condoned.
