ORAL ORDER
Pursuant to the order dated 21.3.2025, the report was called from the learned Family Court, Bhavnagar about outcome of Family Suit No.140 of 2019. The report along with judgment indicates that the petition under the HMP Act has been allowed and the marriage has been dissolved and divorce is decreed. Learned advocate Mr. Oza, upon instructions, submits that no appeal is filed against the judgment delivered in family suit. Present petition is against declining of grant of maintenance u/s 125 of the Code of Criminal Procedure, 1973. Since, on previous date, learned advocate for the petitioner was not present, this Court issued notice to the petitioner keeping the name of learned advocate Mr. DD Vyas as it is. Notice is served, but the petitioner did not remain present. Hence, it appears that learned advocate for the petitioner is not interested in prosecuting the matter any further. Hence, present petition stands dismissed for want of prosecution. Notice discharged.
