(PER : HONOURABLE MR. JUSTICE A.Y. KOGJE) The present appeal is filed by the appellant-State against judgment and order of acquittal dated 05.01.1999 passed by the Additional Sessions Judge, Panchmahals at Godhara in Sessions Case No.196 of 1998.
When the matter is taken up for hearing today, learned Advocate for the respondent accused submitted that the sole respondent-HIRABHAI SHANABHAI RATHVA has expired on 23.01.2025. He produced on record death certificate of the respondent-accused.
In view of the aforesaid, the appeal stands abated. Disposed of accordingly.
