ORAL ORDER
1. Learned advocate for the applicant placed on record affidavit of respondent no.2, which is ordered to be taken on record.
2. This is an application filed challenging the judgment and order passed below Exh.34 dated 18.03.2014 by the learned Judge, Family Court, Ahmedabad in Criminal Misc. Application no.902 of 2009, by which, the learned Judge has directed the applicant to pay Rs.2,500/- towards the amount of the maintenance qua wife and Rs.2,500/- each to minor two son. Learned advocate for the applicant submitted that during Page 1 of 2 Downloaded on : Fri Sep 22 20:50:08 IST 2023 NEUTRAL CITATION R/CR.RA/100/2015 ORDER DATED: 22/09/2023 undefined the pendency of this revision application, the settlement is arrived at between the parties and the wife had received permanent alimony towards the maintenance and it is submitted that if the impugned order is quashed, the wife is not having any objection.
3. The aforesaid contention was not disputed by Mr. Sandip Patel, learned advocate for the respondent - wife. He further submitted that the wife is present before this Court, had also given consent for quashing of the impugned judgment.
4. In view of the above, the present Revision Application preferred by the applicant - husband is hereby allowed. The judgment and order dated 18.03.2014 passed below Exh.34 by the learned Judge, Family Court, Ahmedabad in Criminal Misc. Application no.902 of 2009 is hereby quashed. It is clarified that the aforesaid order is passed in view of the settlement arrived at between the parties. Rule is made absolute to the aforesaid extent.
