ORAL ORDER
The captioned application seeks to condone the delay of 135 days caused in preferring the captioned appeal challenging the judgment and decree dated 28/12/2021 passed by the learned City Civil Court, Ahmedabad in Civil Suit No.3664 of 2002.
The service to the other side is effected by affixing on the conspicuous part of the last address of the respondent.
Having heard the learned Advocate for the applicant and considering the averments made in the application, more particularly, paragraph 4 and 5, without delving into the merits of the case and by taking a liberal approach following the principle of substantial justice, delay of 135 days caused in preferring the captioned appeal is condoned.
Rule is made absolute to the aforesaid extent.
