CONCILIATION ORDER
1. Heard learned advocates appearing for the respective parties. Learned advocates appearing for the respective parties have placed on record the affidavits of settlement of the complainant as well as applicant dated 28.08.2023, wherein it is stated that original complainant has decided to settle the dispute with original-applicant-accused by accepting Rs.12,00,000/- and he does not have any objection if the judgment and order dated 09.07.2021 passed in Criminal Case No.899 of 2019 as well as judgment and order dated 02.08.2022 passed in Criminal Appeal No.56 of 2021 and judgment and order dated 02.08.2022 passed in Criminal Appeal No.53 of 2021 are quashed and set aside, which is the subject matter to challenge of these Criminal Revision Applications.
2. The affidavits of settlement of the complainant as well as applicant dated 28.08.2023 signed by both the parties are taken on record.
3. In view of the fact that the dispute is of the private nature, learned APP does not have any objection if the impugned orders are quashed and set aside.
4. In view of the settlement arrived at between the parties and in view of the fact that now the original complainant does not want to continue with the proceedings, judgment and order dated 09.07.2021 passed in Criminal Case No.899 of 2019 as well as judgment and order dated 02.08.2022 passed in Criminal Page 2 of 3 Downloaded on : Sat Sep 16 16:39:04 IST 2023 NEUTRAL CITATION R/CR.RA/872/2022 CONCILIATION ORDER DATED:
09/09/2023 undefined Appeal No.56 of 2021 and judgment and order dated 02.08.2022 passed in Criminal Appeal No.53 of 2021 are hereby quashed and set aside.
5. In view of the aforesaid, present Revision Applications are disposed of.
6. The applicant is directed to deposit a cost of Rs.60,000/- with the Gujarat State Legal Services Authority, within a period of one month from the date of receipt of this order.
7. The learned Trial Court/Sessions Court concerned is directed to disburse the amount of Rs.6,00,000/- deposited by the applicant, in favour of the complainant.
8. In view of the disposal of the main matter, connected Criminal Misc. Application does not survive and accordingly, the same is disposed of as not survived.
Direct Service is permitted.
