This is an application preferred by the applicant under Section 5 of the Limitation Act for Condonation of Delay of 158 days in preferring Criminal Appeal under Section 372 of the Code of Criminal Procedure, 1973 against the judgment and order of acquittal dated 17.01.2023 passed by the learned Additional Sessions Judge, City Sessions Court, Ahmedabad City in Sessions Case No.410 of 2016. 2. Learned advocate Mr.Shashikant Gade for the respondent Nos.2 and 3 has stated at bar that he has no objection if the application for condonation of delay would be allowed.

3. Considering the averments made and the reasons stated in the application, this Court deems it fit to allow this application for condonation of delay.

4. Hence, present application is allowed. Delay of 158 days in preferring Criminal Appeal is condoned. Rule is made absolute accordingly.
