1. Rule. Learned advocate for the respondent-State waives service of rule for the respondents.
2. This application is filed for condoning the delay of 414 days in preferring Criminal Appeal challenging the judgment and order dated 08.10.2021 passed in Sessions Case No.20 of 2017 by the Principal Sessions Judge, Bharuch.
3. Learned advocate for the applicant has taken this Court to the averments made in Paragraph Nos2 and 3 indicating the cause for delay in preferring the appeal.

4. Considering the fact that the applicant has made out sufficient grounds for explaining the delay of 414 days caused in preferring appeal and also considering the fact that the applicant is in Vadodara Central Jail since 26.03.2017 and assailing his conviction, the present application is allowed. Delay of 414 days caused in preferring Criminal Appeal is condoned. Rule is made absolute to the aforesaid extent.
