                                  ORAL ORDER

1. The present application is filed by the Applicant for enlarging him, on parole leave on the ground of approaching the Hon'ble Apex court challenging the judgment and order passed by this Court whereby the sentence imposed upon him has been confirmed for the offences punishable under Sections 25A and 29 the NDPS Act.

2. Rule returnable forthwith. Learned APP waives service of Rule on behalf of the Respondent State.

3. Considering the ground stated in the Application so also the fact that the jail conduct of the Applicant is reported to be good and also the fact that the Applicant has already undergone more than 7 Years of sentence out of the total sentence of 10 Years imposed upon him, the Application deserves consideration.

4. The application is allowed. The Applicant - NARENDRA DHIRAJLAL KACHA is ordered to be released on parole for a period of 15 days from the date of his actual release, upon his furnishing a personal bond of Rs. 5,000/- (Rupees Five Thousand only) with a surety of the like amount to the satisfaction of the jail authority, and on a further condition that he shall surrender to the Jail authorities on expiry of the parole period.

5. The application is allowed in the aforesaid terms. Rule is made absolute. Registry is directed to communicate this order to the concerned jail authorities by fax / e-mail.
