1. RULE. Learned APP waives service of notice of rule for and on behalf of the respondent-State.

The present application has been filed by the applicant- convict under Section 5 of the Limitation Act for condonation of delay of 553 days caused in filing the captioned Criminal Appeal preferred against the judgment and order of conviction and sentence dated 10.1.2022 passed by the learned Additional Sessions Judge, Kheda at Nadiad, in Sessions Case No.47 of 2017.

Since the applicant-convict is incarcerated in jail and is assailing his conviction and further considering the averments made in the application, in the interest of justice, the delay of 553 days caused in filing the captioned Criminal Appeal deserves to be and is hereby condoned.
