(PER : HONOURABLE MR. JUSTICE A.S. SUPEHIA) At the outset, learned advocate Mr.Baghel, appearing for the appellant has submitted that against the very same judgment and order of conviction and sentence, another Criminal Appeal No.2370 of 2023 is already filed by the present convict, which is already admitted by this Court.
In view of the above, learned advocate Mr.Baghel, seeks permission to withdraw the appeal as well as the application seeking suspension of sentence, with liberty to file a fresh application for suspension of sentence in the Criminal Appeal No.2370 of 2023, in case no such application is filed in the said appeal.
